Étant donné la précarité juridique des favelas à Rio de Janeiro, l’analyse historique de la législation et de la politique urbaine s’avère fondamentale pour comprendre les enjeux sociaux autour de l’accès au sol urbain, ainsi que les stratégies de différents acteurs urbains. Dans ce contexte, cet article tente d’établir une relecture sociopolitique du droit afin d’analyser à la fois comment la réalité sociale construit le droit et comment celui‑ci provoque des répercussions effectives sur le plan social. Ce texte prétend aussi analyser comment la politique urbaine envers les favelas s’est révélée un outil important de marginalisation de la population favelada, ainsi qu’un moyen important de maximisation de l’accumulation du capital à Rio de Janeiro.

Politics, Law and the Favelas of Rio de Janeiro: A Brief Historical Examination
Given the precarious legal status of the favelas of Rio de Janeiro, an historical analysis of the relevant legislation and of urban policy proves essential in order to understand what is at stake in social struggles over access to urban land, as well the strategies of different urban actors. In this context, this article attempts to develop a socio-political re-reading of the law in order to analyse both how social reality constructs the law and how the latter leads to effective repercussions in social terms. This text also aims to analyse how urban policy towards the favelas has revealed itself to be an important tool in the marginalisation of the favelada population, as well as an important means of maximising capital accumulation in Rio de Janeiro.
